PFI (P3) Mechanisms: Courthouse Planning in Ontario


Project Undertaken at IBI Group

Jonathan Hack has conducted a number of planning and risk assessments for delivering new, consolidated courthouses in Ontario based on the Alternative Finance and Procurement Strategy of the Provincial Government. This includes the following courthouse projects:

City of Toronto Consolidated Courthouses
Jonathan Hack worked with Taylor Hazell Architects to address the land use planning, real estate and related development project risks associated with plans for the development of courthouses in Toronto. This included a new Civil Courthouse as part of the Osgoode Judicial Precinct in Downtown Toronto, a new Toronto Centre courthouse, and a new Toronto East (Scarborough) Courthouse. Together, the likely program for these facilities requires between 1.8 million and 2.0 million square feet of new built law courts and offices.

Matters addressed include:
  • A review of planning approvals and risks associated with seeking new approvals for alternative concepts;
  • Real estate market analysis, including potential land costs and highest and best use of prospective sites and surrounding properties;
  • A risk analysis for the development of these projects, ranging from planning and property risks, to financial and other risks associated with the Public-Private Partnership delivery model for these projects; and
  • Strategic advice on the timing of planning approvals and site acquisition.

St. Thomas Courthouse
Included real estate, planning, risk analysis, and detailed site location evaluations.

Thunder Bay Courthouse
Included real estate, planning, and oversight of urban design guidelines as part of the project development and compliance team working on behalf of Infrastructure Ontario during the DBFM (Design-Build-Finance-Maintain) competition for selection of a P3 partner to develop the courthouse in Downtown Fort William.

Wellington County (Guelph) Consolidated Court House and Halton Region Consolidated Courthouses
Included a detailed risk analysis and business plan.

Frontenac County Courthouse, Kingston
Consisted of a planning and real estate assessment for a consolidated facility in the City.
